China released final ruling on anti-subsidy investigation EU Potato Starch

Below the final ruling of the Ministry of Commerce of the People's Republic of China on anti-subsidy investigation against potato starch imports from the European Union:

The Ministry of Commerce of the People’s Republic of China (MOFCOM), released, on September 16, 2011, its final ruling on anti-subsidy investigation against Potato Starch imports from EU in its Announcement No.54, 2011. The final ruling confirm that subsidy exists in potato starch imports from EU, and has caused substantial damage to China’s potato starch industry.

According to the final ruling, importers of EU Potato Starch should pay anti-subsidy tax at the Chinese Customs in accordance with the subsidy rate determined by the ruling. The subsidy rate ad valorem by the responding party is 7.5% to 12.4% and 12.4% by non-responding party.

It is the first time for China to make on anti-subsidy investigation on imports from EU. Chinese investigation authorities made a final ruling in the light of Chinese laws and WTO rules, based on just, fair and transparent procedure, laws and facts.

The imports under the investigation, also known as starch from potato, refined starch from potato, or potato flour, are used mainly in food processing industry in China. Tariff No. is 11081300 under Import and Export Tariffs of the People's Republic of China.

The Potato Starch sub-Committee of China Starch Industry Association submitted, on behalf of China's potato starch industry, a petition to MOFCOM on June 30, 2010. And MOFCOM started anti-subsidy investigation on August 30, 2010. MOFCOM released initial ruling on May 15, 2011.

MOFCOM started, on April 19, 2011, to levy anti-dumping duties ranging from 12.6% to 56.7% on potato starch imports from EU.
